Action commenced September 13, 1952 by the plaintiff, Drott Tractor Co., Inc., a Wisconsin corporation, against the defendant,
Arthur Kehrein, a general contractor, for damages to plaintiff's real property alleged to have resulted from the defendant's
negligence. The case was tried to the court without a jury. Findings of fact and Conclusions of law were filed by the court.
Judgment was entered on February 21, 1956 in favor of the plaintiff for $2,139.48 together with costs. The appeal is from
the judgment. It is undisputed that the plaintiff owns land lying immediately south of West Bluemound Road and immediately east of North
39th Street in the City of Milwaukee. There is a concrete building on part of the land, the west side of which building is
contiguous with North 39th Street and the north side of which is set back a considerable distance from West Bluemound Road.
There is a sharp upgrade on West Bluemound Road from North 39th Street to North 38th Street.
